SOLON, Ohio — The Solon Police Department announced Monday that the officers involved in a fatal shooting in March have been cleared. It happened on March 17 on Bainbridge Road in Solon when Officers Steven Davis and Nicholas Kline attempted to stop a vehicle fleeing a routine traffic stop. It was driven by Kevin Bailey, 22, of Sylvania Township. Police said the officers came under fire before they could exit their vehicle. They said Bailey shot through both police cars and hit Davis in the arm and vest. Bailey was shot and died of four gunshot wounds to the head, torso and extremities. The investigation on the shooting was conducted by the Ohio Attorney General's Bureau of Criminal Investigation, which then turned over the results to the Cuyahoga County Prosecutor's Office for review. Friday, the prosecutor's office and grand jury agreed "there were no improprieties in the officer's actions and that the use of force was based on the actions of the suspect," according to a release from the Solon Police Department. Both Davis and Kline have since returned to duty, according to the release. Solon Police Chief Christopher Viland thanked the investigating agencies and said he was grateful no officers or civilians were hurt during the incident. "I don't think there was ever any question that the actions taken by the Solon Police on that night were unfortunate but necessary and completely driven by Mr. Bailey's unprovoked choice to were confident that an objective review would reach the same conclusions that we have internally, that our officers responded in a competent and professional manner to unthinkable attack on a Sunday evening, neutralizing an armed threat by someone actively trying to take their lives, and immediately rendering first aid upon the incident's conclusion."
